Pensions Ombudsman Decision,

A Derbyshire pensioner who had his injury pension reduced to band one when the force started reviewing IOD's as a result of HOC46/2004 guidance has been unsuccessful in his complaint to the Pensions Ombudsman.

This has been a protracted struggle spanning a decade and this pensioner has previously been very successful when his case was the subject of Judicial Review - this case resulted in HOC46/2004 being finally declared unlawful and withdrawn.

Our colleague has been doggedly determined and his persistence and tenacity should be appreciated by all IOD's. We all owe him a debt of gratitude.

The P O Determination.

With Derbyshire likely to start reviews again in the near future, all Derbyshire IOD's need to be aware of our own organisation IODPA. There are already a number of Derbyshire members and valuable assistance is readily available including legal services from our legal team. IODPA is very proactive and there have been some recent very positive developments as a result of IODPA initiatives.
