How do you find out if SMP is going to be impartial?

Post by sarasa on Wed Jul 13, 2016 8:07 pm

I have a referral back to SMP under R32(3) PIBR 2006. The PPA have chosen their SMP who is also the FMA. Under the regs the SMP should be agreed between them and me. How do I know if their chosen SMP will be impartial? Is there a list of SMPs? I have never heard of FMA acting as SMP is this good practice? Any comments would be appreciated.

You need to remind your force that you have a legal right to 'agree upon' the selection of a duly qualified medical practitioner to make the reconsideration of an earlier decision (made by a different medic who is now either unable or unwilling to make the decision themself.)

The force can't just say, 'we will use this SMP or FMA.' They have to seek and obtain your agreement.

Please send me a private message, as I need to offer you advice which should not be on a public forum.
